Prerequisites
The admission requirements for the Master's degree
Objectives
- To understand the scope of Union citizenship and the evolution of its role and its relationship with the nationality of the Member States, within the framework of EU law.
- To become familiar with the framework and functioning of the right to free movement and residence inherent in Union citizenship. To learn the fundamental principles of EU legislation concerning the rights of entry, stay and residence of third-country nationals.
- To provide the necessary tools to understand the basis of the legal architecture of the European internal market, namely the rules governing the fundamental freedoms (in particular, the free movement of persons and goods, and the freedom of establishment and to provide services) and EU competition policy.
- To introduce the foundations and concepts of the Area of Freedom, Security and Justice, including immigration and borders management, judicial and police cooperation in criminal matters, and judicial cooperation in civil matters.
- To familiarize students with the case law of the EU Court of Justice in these fields, and in particular with the methodology and criteria used by the Court to assess the compatibility with EU law of measures adopted by Member States which may constitute restrictions on citizenship rights, freedom of movement or free competition.
- To enable students to acquire the analytical tools required to assess and provide reasoned opinions on specific cases related to the subject matter studied.
- Building on the knowledge acquired throughout the course, to train students to work in greater depth on specific topics of the programme, for example through the preparation and completion of a Master's Final Dissertation (see the relevant guidelines).
Learning outcomes

- Seek out information in the scientific literature using appropriate channels, and use this information to formulate and contextualise a research topic.
- Analyse, synthesise, organise and plan projects and assignments related to the area of study.
- Integrate knowledge and use it to make judgements in complex situations, with incomplete information, while keeping in mind social and ethical responsibilities.
- Communicate and justify conclusions clearly and unambiguously to both specialised and non-specialised audiences.
- Analyse the principles of distribution of competences between the EU and its member states.
- Apply to the different branches of the EU legal system the principles that govern the distribution of competences.
- Map the various legal paths available for defending the different rights that are recognised in each branch of the EU legal system.
- Assess the effectiveness of the various legal paths available for defending rights.

- From the EEC to the EU. Evolution of integration. Principles and values. The internal market, concept and content. The Area of Freedom, Security and Justice.
- Citizenship of the Union. Concept, content and effects. Relationship with nationality. The role of the CJEU in its definition and regulation.
- Free movement of persons in the EU. Citizenship, mobility and right of residence.
- The EU and natural persons who are nationals of third countries: entry, residence and mobility regimes in the EU.
- Fundamental freedoms and the internal market: free movement of goods, freedom to provide services, right of establishment, free movement of workers and free movement of capital.
- Company law in the European Union.
- European Union competition policy.
- Judicial cooperation in civil matters. Judicial and police cooperation in criminal matters.
- Conferences or seminars that may be organised during the course.

The educational progress is organized from three different types of activities:
1. Professor directed activities
These activities are developed in the classroom during a semester, within the timetables foreseen for the module and under the direction of the teaching staff. They may be theoretical or practical, but this distinction between theoretical and practical activities is not a rigid division, because both aspects are always integrated in the courses. Although it is not approximate, we can calculate that 75% of the teaching would be devoted to theoretical aspects, and 25% to practical aspects. Attendance to classes is compulsory.
1.1. Theoretical aspects:
The theoretical classes are based on the teacher's exposition of the corresponding subjects of the programme. Students are expected to participate actively, and dynamic interaction in the classroom will be encouraged through the posing of questions or examples and the clarification of any doubts.
1.2. Practical aspects:
The practical part of the sessions will be mainly devoted to the analysis of the case law of the Court of Justice of the European Union and the resolution of practical cases, based on the legal provisions and their interpretation by the Court of Justice. Normally, this practical part will be developed orally, although students may also be asked to resolve written practices.
The materials for the practices will be published in the Virtual Campus or they will have to be looked for by the students, through the electronic resources and the collections available at the Social Sciences Library of the UAB or at the library of the European Documentation Center, located in the UAB campus.
1.3. Complementary seminars and/or conferences:
In addition to the courses scheduled, specialized seminars or conferences may be organized and delivered by invited professors. The organization of these activities is subject to the availability of the invited speaker(s).
It will also be possible for students to attend seminars, workshops or conferences organized as part of the Master’s programme or as complementary initiatives.
2. Supervised activities
These are activities carried out by students under the supervision of teaching staff and based on their instructions. During the semester, at least three sessions will be devoted to supervised activities, which will be carried out in writing and, in principle, in the classroom. The results of these activities will form part of the module assessment, as explained in the following section. These activities may consist of preparing a dissertation, answering questions on theoretical aspects, solving case studies or analyzing a text or document. They may also involve carrying out work outside the classroom, following the instructions provided by the teaching staff.
3. Autonomous activities (carried out individually or in groups)
Reading and studying the bibliography and other materials; sourcing the materials required for course preparation and assessment tests.

The assessment system is based on continuous assessment, comprising activities which each lecturer will plan and about which they will inform students in advance. Some will take place entirely in the classroom, while others may be submitted in the way and by the deadline specified by the lecturer responsible for the activity. These activities may include oral or written presentations, group work, reading and analysing statutory texts and court rulings, multiple-choice tests, or debates, amongst others. Some of these activities may be common to different thematic blocks within the programme.
The module mark will be calculated as the arithmetic mean of the marks obtained in the continuous assessment activities.
